A citizen of Tameside writes to the TMBC Borough Solicitor


Dear Borough Solicitor

I am absolutely disgusted that I like thousands of the Denton Electorate have received Labour Posters delivered to my home which state: "Please display this Poster in your window" which states: Say No To Police Cuts, Re-Elect Brenda Warrington

The message implies that Police Cuts will be or have been arranged in Tameside Greater Manchester whereas the facts are that an increase in Police Officers (approx 14) has been allocated. This is manipulated terminology intended to indicate especially to thousands of the Elderly and vulnerable an element of "Fear" by implying a reduction in Tameside Police Officers.

As the Borough Solicitor I believe this breaches the required conduct of all those Councillors and MP`s depicted on this Poster leaflet, and you should act accordingly and publicly condemn the intended poster as being deliberately misleading with the intention of creating Fear in the Tameside Electorate in an effort to secure votes for Labour.

I trust you will observe your need for objective impartiality in your role as monitoring officer for TMBC, and ensure full clarification is immediately offered to the Electorate.

In conclusion I requested last week that the Tameside Advertiser should permit my letter to be published which would expose this intended fear tactic in order to gain Labour Votes.

Having received no response the following correspondence was sent

Dear Ms Stewart

Because the May Elections are imminent, I would like to know what your intentions are concerning the deliberately misleading Poster Leaflet distributed on behalf of Councillor B.Warrington which I notified to you Weds 13th April 2011

Any response delay on this issue, or refusal to address this situation will have ramifications for any declared result which occurs. Because I will vigorously pursue this serious Election incident.

I would suggest that you immediately ensure all such Posters displayed in any residential window or any other form of public display in the Denton area represented by Councillor Brenda Warrington be removed urgently, with a public statement made by yourself condemning such an intentional misleading campaign leaflet.

I do not currently have access to the offending leaflet in question but I suspect it will be similar to the Labour leaflet pictured above (click to enlarge) which is currently being distributed in Dukinfield. Dukinfield and Denton of course are in the same parliamentary constituency so there is a strong likelihood that this leaflet is very similar to the one Mr Hall complains of. The Conservatives are also putting out an excellent leaflet exposing the Labour scaremongering campaign regarding fictitious police cuts. Tameside Citizen

Good information. Did you know there is an on going Masonic plot to subvert and control the Catholic church. That is the reason we are constantly bombarded with scandals involving paedophile priests. While there is no doubt the celibacy rule enforced upon Catholic priests can lead certain priests to behave in a deviant manner their numbers are miniscule when compared to the number of good and devoted priests who only ever do good.

The Masonic controlled media have hammered home Catholic priests = paedophiles for decades now and the masses, as ever have fallen for it hook, line and sinker. The very few cases of sexual abuse within the church and spanning many decades which do get discovered always gets prime time news saturation whereas by comparison the utterly depraved paedophiles from the main UK political parties who rarely get a mention other than in local press.

The Masons are aware that many of their hirelings on the political scene are real sexual deviants but they deliberately prevent the sheeple from seeing the true extent of their behaviour whereas every isolated case related to the Catholic church is reported as if it is a true epidemic.

Dear Mr Hall,

Thank you for your email making a complaint about alleged election malpractice received on Wednesday 13/04/2011 at 20:27hrs. As I have previously advised you it is not possible for me to respond instantly to your concerns particularly whilst I am engaged in managing the election process. I apologise if this causes you undue distress or inconvenience.

Please note neither the Council, nor the Returning Officer have authority or jurisdiction to investigate or make determinations as to the validity or legality of election material. This is a matter for the Police and/or courts in determining either criminal offences or electoral malpractice.
However, I can assure you this is not electoral malpractice but normal electioneering, where one political party sets out its policies and/or criticises another parties.
It is not for the Returning Officer or his staff to become involved in making statements or observations on any election material.
Campaign publicity material is subject to a number of restrictions under electoral law, and is also subject to the general civil and criminal law relating to published material. For example, no campaign publicity material may resemble a poll card. The restrictions and offences in relation to political leafleting are set out in the electoral commission guidance to Candidates and Agents which I have set out in the box below and attach. The High Court’s ruling in the Phil Woolas case gives clarity on the legal position as to what is banned. As the ruling says, “There is in our judgment a very significant difference between a statement that goes to the political conduct of a candidate and one that goes beyond it and says something personal about his personal character … Freedom of political debate must allow for the fact that statements are made which attack the political character of a candidate”.
Clearly, it is a matter for the electorate to decide and chose between the candidates and their policies when placing their vote.
Some newspapers run stories during the election and feature some or all candidates. While the allocation of broadcasting time is prescribed in legislation, the way that newspapers communicate their views on political issues is not. Newspapers may take whatever view they like on the candidates at the election and may include as much or as little coverage as they decide. Clearly, the Council has no influence or jurisdiction in relation to local newspapers and what they print as they are wholly independent of the Council.

I realise you will remain unhappy with this response, and therefore would strongly recommend that you seek the advice of the Electoral Commision, the independent body set up by the UK Parliament to ensure integrity and public confidence in the democratic process who can be contacted via their website at: http://www.electoralcommission.org.uk/contact or by phone on (020) 7271 0500. I am seeking your considered opinion concerning the TMBC Standards Committee its formation,its powers,and its responsibilities towards the Tameside Electorate seeing it is not an elected assembly
or held to account by any other form of other administration.
To assist your thoughts I have denoted certain aspects of legistlation applicable to TMBC in the persuit of the Common Law Rights associated with Misconduct in Public Office.
It would appear that direct conflicts of association and interests exist between members of the TMBC Standards Committee and members of the TMBC Administration which could create a lack of impartiality
and therefore a possible unjust,unfair or incorrect determination resulting should a complaint be investigated by the Standards Commmittee under its present format.
It is within my Rights as a member of the Tameside Electorate that I raise this matter and I am seeking a full and comprehensive response from yourself as the Borough Solicitor on what I believe is a serious issue.
Now based on Official Legistlation according to the High Courts it needs to be clarified whether the TMBC Standards Committee is a fit group of individuals to administraste the Common Law associated with Misconduct in Public Office seeing that its members have a direct conflict of association with those acting in Public Office positions within TMBC.
Now these are my considered opinions and the Tameside Electorate need to know their rights which should NOT BE USURPED BY ANY STANDARDS COMMITTEE chosen by TMBC itself.

I have read your complaint but I am unclear as to what it is you are asking or seeking.
The Standards Committee is set up in accordance with legislation and is currently overseen by the Standards for England, the national regulator. You can read more about the regulator at http://www.standardsforengland.gov.uk/

Should that be the notorious TMBC Councillor Brenda Warrington spouting off who denied to Our Historic House of Commons Official Registry of Intertests,that "SHE HAD NO INTERESTS TO DECLARE" which showed on the Anderew Gwynne MP House of Commons Interests site.
Its a good job "I found you out" Councillor Warrington knowing you were a well paid TMBC Councilloor and also had 3 Outside Declarable Interests which should have been declared,in fact your mate Andrew Gwynne MP was still a TMBC Councillor at that time and obviously was fully aware therefore that your Hof C declaration was totally FALSE, being neighbours and close comrades on TMBC

We Britons are endlessly propagandised, by owned publications of the cheap-labour lobby, about how immigration is supposedly good for the British economy, It is worth reviewing, for the 38,399the time, why this is fantasy economics. To wit:
a. Immigrants increase our aggregate GNP, simply because more people working means more output. But this is not a valid measure of economic health. India has a larger aggregate GNP than Switzerland, but is a much poorer country, because it's per capita GNP that determines

a country's wealth. Technically, we could expand our aggregate GNP by annexing Bangladesh or Zambia! (Sound familiar? This is a lot of what the Empire was about, which is why ordinary Britons didn't get anything out of it.)

b. Immigrants reduce our per-capita GNP, by reducing the average skill level and capitalisation of the workforce. Skills and capital are what make a workforce productive, and thus well-paid. For one, they are mostly cheap labour, with low-quality skills, so they produce less, per capita, than the existing labour force, diluting the average. For two, they cause the finite capital stock of the economy to be divided among more people, diluting our capitalisation.

c. Immigrants retard technological progress, by encouraging the substitution of cheap labour for technology. What, for example, do you think is behind the re-appearance of (highly inefficient) manual cash-washes? Anyone who's been to a country like Japan, where cheap foreign labour is almost unknown, and technology fills the gap, will know that whole swathes of the British economy are ridiculously backward in this respect.

d. Immigrants reduce our real GNP by causing inflation, principally in housing prices, but also in other things. So the real standard of living of Britons is lowered.

e. Immigrants cause social costs, for everything from unemployment to policing to schools to council housing, which they do not pay enough in taxes to pay for. The employers of cheap labour are, in effect, extracting a subsidy from the taxpayer, because they don't bear these costs.

f. Truly exceptional immigrants, like talented inventors and industrialists, who might add something to the economy that wouldn't otherwise be there, may indeed exist. But they are exceedingly rare, their value does not exceed the cost of letting all the other immigrants in, and such people will probably succeed anywhere they go, so we need not feel sorry for them.

As Borough Solicitor for Tameside MBC, I am not responsible for the content of election communication distributed by political parties throughout Tameside.

The material on the leaflet that you refered to earlier is neither illegal nor misleading, and I resent the implication that my refusal to intervene in the matter somehow constitutes a lack of impartiality. Your attempts to undermine my authority are becoming increasingly vexatious and I am minded to refer the matter to the police.

Firstly the leaflet you refer to is in fact 50% a detachable Poster for Window Displays in Denton and Dukinfield by the thousands who received them,and those seeking election votes have requested that the recipients of the Posters should display THE POSTER and promoting the Labour Candidates with say NO TO POLICE CUTS.(full stop)
Now misleading is certainly an serious issue as I hope the Electoral Commission will now be considering because the reality is that Tameside is Not Down for Police Cuts as implied on the POSTER by not clarifying Tameside is not intended to have Police Cuts, because in reality in Tameside. "Police Increases"are planned.
Any potential candidate anywhere whether standing for election in Cardiff,Preston,Crewe etc could equally suggest to their intended Constituents Vote For Me,if YOU don`t want to see the numbers of GP`s and Consultants Cut (where London was facing possible Cuts)but not "their voting public)or Vote for Me if you don`t want to see "Cuts in
Buses" (where Birmingham was facing intended cuts)but the locality where the Candidates were canvassing.
Council Elections are held so the locality concerned can have their local objectives achieved,not whether Birmingham or London should not have cuts.
Therefore to imply because Manchester was not mentioned in the intended WINDOW DISPLAY POSTER and the restricted terminology did not clarify it was Manchester facing Police Cuts not Tameside.
As for openly threatening me
Ms Stewart with Police Action,because I make perfectly valid points to denote the need at all times in Tameside for all Employees of TMBC who administrate our daily lives should ensure impartiality,openness,
accountability,probity and all human rights be applied in every single instance to the 220,000 Electorate.
How you have interpreted my communications with yourself should be open to very serious perusal because"Your Authority" as you stated, should always be openly available to public scrutiny at all times as is the Prime Ministers Authority be open to scrutiny by the media,the public and other politicians.

There are a lot of pissed off people who have previous experience of the Zimbabwean standard of elections in Tameside. The goings on in Hyde Newton two years ago being a prime example. BOROUGH WAS UNDERMANNED DURING LABOUR’S YEARS OF GOVERNMENT

The number of police officers for Tameside is to be increased from April onwards, after it was revealed that the borough has been undermanned for several years – thanks to the last Labour Government.

From the 1st April, an extra 15 police officers are to patrol Tameside’s streets following an audit of police numbers across Greater Manchester, which revealed that not enough police officers had been stationed in Tameside after 13 years of Labour Government.

Tameside Conservatives welcome the additional officers to Tameside, and look forward to the increased efforts to reduce the high crime figures.

As Borough Solicitor for Tameside MBC, I am not responsible for the content of election communication distributed by political parties throughout Tameside.

The material on the leaflet that you refered to earlier is neither illegal nor misleading, and I resent the implication that my refusal to intervene in the matter somehow constitutes a lack of impartiality. Your attempts to undermine my authority are becoming increasingly vexatious and I am minded to refer the matter to the police.

I must assume that the Borough Solicitor has not requested that the blog attributed to her be removed.

May I add that the terminology utilised on now both these two blogs showing on the TC site, is in my opinion someone who has some knowledge of how to impersonate a Solicitor,or briefed on the use of the wording required to impersonate a Solicitor.
Whichever applies if I was the Borough Solicitor I would be quickly seeking confirmation that these two dubious blogs are immediately removed.

The Regulation of Investigatory Powers Act 2000 (c.23) (RIP or RIPA) is an Act of the Parliament of the United Kingdom, regulating the powers of public bodies to carry out surveillance and investigation, and covering the interception of communications. I have no idea to what you are referring, but I can assure you that I categorically do not engage in any website or blog communications whatsoever. If you have read something purporting to be from me I can assure you it is not. I would strongly recommend given you feel threatened and harassed you report the matter to the police for investigation as they will be able to trace the computer from which the message has come from.

I have explained to you that I have no jurisdiction or authority in respect of election leaflets but I have given my opinion as to their legality. How amazing the TMBC Solicitor does not demand the 2 bogus E.Mails showing on TC in her name are removed.
Can you imaging any Legal person allowing someone to impersonate them
and does nowt about it.
Could it be she rather enjoys reading the comment because it identifies with her thoughts.
Most definately strange and highly suspicious me thinks.
So who is behind the scam ?,seems like they can impersonate anyone at liberty with no problems.

Locklin was a top local Party bigwig on first-name terms with Tony Blair, after escorting the PM during visits to his constituency on several occasions.

About 10-0am on Monday I was entering Ashton near the Pig meat
factory (used to be Dixons) and opposite the small garden centre),when I saw approx 12 handy looking lads something akin to a dirty dozen, fit, aged 18-20 plus walking towards Dukinfield King Street away from Ashton with its group leader a smart office type suited up bloke with a clip-board.
Could these be an electioneering party chosen for their robust appearances I thought, or is it a community service group (but they didn`t look like a working party)
but just like a group of young blokes assisting the bloke with the clipboard and on a mission.
Could this have been a look into the future (or present)canvassing team on a trip into Dukinfield.
Just an observation out of the norm
