Well it appears Judge Berg is a man on a mission and it was no coincidence that he ended up as the ‘impartial’ (cough/splutter) judge who presided over what was arguably Tameside’s most notorious race hate trial. A judge has vowed to lock up people convicted of racial abuse after a surge in the number of cases. District Judge Alan Berg said he was alarmed at the behaviour of 'worthless people' and would use jail sentences to restore 'peace and some sense of semblance of civilisation'. Judge Berg said the 'wider consequences' of letting the problem go unchecked must be 'avoided at all costs', warning that abusive and violent racists can expect to go to jail. He said: "Where the offence is so serious, the starting point for a sentence will always be custody. The racial element of an offence both demeans and humiliates the victim in addition to any other harm done to them." Figures unearthed by Hazel Grove MP Andrew Stunnell show the number of racially aggravated attacks in Greater Manchester soared from 693 in 1998, to 3,637 in 2007. Greater Manchester Police say the rise is down to better recording, and a greater effort by prosecuting authorities to incorporate racial aggravation into criminal charges where appropriate.

Since the West trial I have researched some of the cases dealt with by Judge Berg. We, as a nation are entering dangerous and uncharted waters by appointing judges with a political mandate. It may be the likes of ‘West the Pest’ and his Party affiliates who are currently the target, but if you study history you will know that when you pervert the judiciary they become a law unto themselves. Think Hungary in the 1950’s or Chile in the 70’s. Justice for all does not apply when you have a judge who clearly states he is working to an agenda. Forget West and think about the wider implications.
Mr Kugow hides his actions on the night before the court case, from the court. Mr Kugow invited Mr West into his house to threaten and intimidate Mr West. Telling Mr West that he had no option but to plead guilty and show remorse before this Judge Berg. Mr Kugow went into all the scare tactics to get Mr West in that frame of mind to plead guilty the next morning. What was Mr Kugow doing asking Mr West to come into his house, knowing that Mr West was on bail not to contact him or his partner? How Susan Holt can make a statement to the police in relation to the argument between the two, when she never witnessed the incident in the first place.
Mr Kugow perverted the course of justice when he invited Mr West into his house and told him to plead guilty.
Mr West you were the one in the dock who uttered those now famous words guilty,is that because you promised to tell "the truth the whole truth and nothing but the truth"
Nobody stood there with you and uttered those words it was you, and lets not forget you had real legal advice, and you will have had the bar room lawyers assisting you from your party, many of then use to the courts.

This would be a great story if there was actually a trial and the judge had imposed some sort of custodial sentence but as Westy pleaded guilty and got off with a small fine it doesn’t quite work.
West took the easy option he could not defend his actions, he was advised to seek mercy from the courts so he did, had he not done so he would have been locked up.
Looks like he did a deal for fine and a hand slapping exercise just the sort of sentence his party campaigns against.
£500 and odd fine for having a slanging match with your neighbour when you've no prior convictions, while a quarter of BURGLARS are let off with a caution, THIEVES with long criminal records are fined £200 and driving without insurance carries the same 'penalty'. West bottled it in the face of an utterly prejudiced and politicised judicial system but that's the only 'offence' he committed.
Judges should not be commenting on specific issues like this, they're supposed to be impartial.

Mr Walker I've said before, it's to my ever lasting regret that I pleaded guilty. I had a solicitor that had no interest in defending me at all. What keeps me going for 2010. What Mr Kugow and I know, what to place on the night before the court case.
Mr Kugow sat there at his kitchen table and perverted the course of justice! Mr Kugow and his partner gave me the full treatment of scare tactics. If Mr Kugow was confident in going to court the next morning, then why did he feel the need to invite me into his house the night before to intimidate me into pleading guilty.

'Tailoring' sentencing to suit individual criminals makes things worse by creating confusion and uncertainty. Czech delay could mean British referendum on Lisbon Treaty
David Cameron might be able to hold a referendum on the Lisbon Treaty because the Czech Republic will probably delay its ratification of the agreement until after a general election in Britain, European Union leaders have been told.
Jan Fischer, the Czech prime minister, has privately warned other EU leaders that a legal challenge could impose a "long delay" on his country's ratification, perhaps until after the British election, widely expected next May.
Mr Cameron has pledged to put the Lisbon Treaty, formerly the European Union's constitution, to a popular vote in Britain as long as it has not been ratified by all 27 member states. If every country has given its approval and the Treaty has officially come into force, Mr Cameron's options would be extremely limited.
Opinion polls suggest that Irish voters will endorse the agreement in a referendum next month, while Germany and Poland are close to completing their own ratifications, leaving the Czech Republic as the only laggard.
The delay in Prague might create an opening for Mr Cameron – assuming he wins a British election – to hold a referendum in his first weeks in office.
Sources told The Daily Telegraph that EU leaders learned of the development during private – and ill-tempered – talks in Brussels last Thursday. Senior diplomats said that President Nicolas Sarkozy of France erupted with "fury" after Mr Fischer raised the prospect of a long delay.
"Sarkozy exploded and described the Czech position as scandalous and unacceptable," said an EU diplomat. "He warned the Czechs to get it 'sorted out' quickly if Ireland votes 'Yes', as the Irish Prime Minister had just told them is likely."
Mr Sarkozy then threatened the Czech leader with unspecified "consequences" if Prague allowed the delay to trigger a British referendum that would probably lead to the Lisbon Treaty's rejection.
"There is no question that we will accept to stay in a no-man's land with a Europe that does not have the institutions to cope with the crisis," the French president is believed to have said.
The Conservatives want to keep the Treaty unratified until after the British election – and they have privately urged the Czechs to drag their feet. "We've made ourselves quite clear. The Czechs know where we stand on this and what we hope for," said a Tory source.
If, however, Mr Cameron wins power and the Lisbon Treaty has come into force, he has not spelt out what would follow, saying only that he would "not let matters rest there". Privately, Mr Cameron's aides are worried that he would then come under pressure from eurosceptic Tories to hold a referendum even on a ratified treaty.
This would effectively become a vote on whether Britain should stay in the EU – and Mr Cameron would be highly reluctant to allow such a referendum. William Hague, the shadow foreign secretary, has privately called this issue a "ticking time bomb" under Mr Cameron's leadership.
A group of Czech senators, supported by Vaclav Klaus, the country’s eurosceptic president are planning a detailed constitutional challenge to the Lisbon treaty.

Please could you tell me what you think of the following travesty of justice. I think considering the seriousness of the attack on my stepson on the canal, the police failing to investigate and taking three months to contact the said victim is an absolute disgrace and a shameful reflection on the so-called British justice system. This lad was attacked on the canal, he and his bike were thrown into the canal. Yet the police can afford the resources to send three police officers to my house armed with cameras to take photographs of flags. Can I ask you, does the attack on the canal not deserve a full police investigation? The prosecution against myself was completely political. The complainants even wrote to the police, asking for the complaint to be dropped. Indeed, one of them knocked on my door saying it was silly to go to court over an argument in the back garden, which I agree with. I would say that the priorities of justice are totally unbalanced in this country. My prosecution was politically motivated, and the violent crime against my stepson goes totally uninvestigated, now please tell me, where is the logic and justice in that?

Anonymous I regret having a shouting match with Mr Kugow, if I could turn the clock back to that day now! then I would just ignore him. The fact is, that the flag was never on Mr Kugow's property. He would still have a problem about the flag in my garden where ever it may have happened to be placed! Does Mr Kugow regret his actions on the night before my first court appearance? How can it be right in the sight of justice, to intimidate and put pressure on someone to get them to plead guilty? Mr Kugow ran to new charter to get my partner and her son thrown onto the streets, this because I posted an anti-fox hunting comment on this blog. If Mr Kugow was a man of honour, then he would not have used intimidation and scare tactics to get me to plead guilty. It should not have been left to Mr Kugow to say to me! 'you have no option but to plead guilty.' If Mr Kugow was confident about his case against me then pray tell me this, why did he feel the need to resort to intimidation and scare tactics while I was there in his kitchem?
